Lawyers Gather To Discuss Cross Border Personal Injury Claims

Top lawyers from the UK, US and Europe gathered last week in Manchester to tackle the latest challenges facing people who suffer injuries overseas, ahead of the busy winter holiday season.

The seminar - Cross Border Personal Injury – Handling Claims for those Injured Abroad at Manchester’s Civil Justice Centre on November 4 – looked at the additional hurdles faced by those who have been seriously injured while overseas, and examined recent legal developments in injuries sustained overseas.

It was organised by Gerard McDermott, a leading personal injury QC dealing with catastrophic injury, such as brain or spinal cord damage, and was chaired by leading aviation lawyer Geraldine McCool of Manchester-based MPH Solicitors.

McDermott QC, who is based in London and Manchester, with associated offices in Abu Dhabi and New York, said: "There is a great deal of red tape to untangle when someone is injured overseas. Even in the European Union member states have different laws and processes which can make bringing a claim for a serious injury extremely difficult."

"The law is developing in this area and we will be looking at what the latest developments are and best practice in handling these claims ."

He added: "An understanding of how catastrophic personal injury claims can be made in other jurisdictions has to be a vital element of any lawyer’s remit when working in this field."

"At what can be the most difficult time in a person’s life and their family’s life, when they have suffered a life-changing injury, it is essential the legalities are not slowed down or hindered simply because there is a cross border element to the claim.
