Solicitors have warned that insurance providers are abusing the scheme set up to help in personal injury cases for road traffic accidents (RTAs).
The scheme, which was introduced by the Ministry of Justice in April this year, aims to speed up the processing of claims that have a value less than GHBP10,000. An integral part of this process is where solicitors initially submit claims data to insurers through an online resource.
However, solicitors are saying that this system is being abused, as insurers are informing their own panel solicitors companies to upload claims by victims to them through the portal, and that this is happening in cases where the victim has already picked a different firm to represent them.
If the victims preferred representative are not be able to log their claim, this stops the victim from getting impartial representation for the claim for compensation .
However, the Association of British Insurers (ABI) have said they are unaware of any insurers that have instructed legal firms to submit claims to them on behalf of victims when they already have representation through a solicitor .
