A partner at a Kent law firm has lost his age discrimination case after being compulsorily retired at the age of 65. Leslie Seldon from Orpington worked as a civil litigator for Clarkson Wright and Jakes legal firm for 35 years before being forced to retire in 2006. Angry at his forced exit, Mr Seldon took the unusual step of taking his own solicitors firm to an employment tribunal and then to the Employment Appeal Tribunal, without success on either occasion.
Mr Seldon continued to fight on, however, taking his case to the Court of Appeal, complete with the backing of the Equality and Human Rights Commission . However, despite the new wave of age discrimination legislation, Mr Seldon this week lost his case as Sir Mark Waller dismissed the appeal. Sir Mark said that the law firms actions could not be described as unlawful as they acted with the same social aim as the government that is, to promote the interests of young would-be employees and actual employees with respect to employment and promotion.
The decision is sure to prove a contentious one, especially at a time when the government is proposing an end to the fixed retirement age.
